Terms of Service

1. Acceptance of Terms
By accessing and using Deladesk’s services, you accept and agree to be bound by these Terms of Service (“Terms”). These Terms form a binding agreement between you (“Client”) and Deladesk (“Service Provider”).
2. Service Description
Deladesk provides managed virtual assistant services tailored for real estate professionals. Services may include, but are not limited to:
- Email and inbox management
- CRM updates and database maintenance
- Lead follow-up and nurturing using pre-approved scripts
- Appointment scheduling and calendar management
- Administrative support
- Document support and transaction coordination (non-legal)
Deladesk does not provide legal services or legal advice. All contracts and legal documents must be prepared and/or reviewed by a licensed real estate broker or attorney.
3. Service Coverage
Services are provided during regular business hours (generally 9:00 AM – 5:00 PM EST, Monday through Friday, unless otherwise agreed). Deladesk does not provide 24/7 live support or instant response. All tasks are handled within the agreed daily cycle.
If a virtual assistant becomes unavailable or resigns unexpectedly, Deladesk will use reasonable efforts to assign and train a replacement promptly. Temporary delays may occur but will be minimized to the extent commercially reasonable.
4. Payment Terms
Services are billed as a prepaid monthly retainer based on the selected plan. Work will not commence until payment has cleared. Mid-term upgrades are permitted, with fees pro-rated. Downgrades take effect in the next billing cycle.
Payments are non-refundable. Late payments beyond a five (5) day grace period may result in service suspension.
5. Confidentiality & Data Protection
Deladesk agrees to maintain strict confidentiality of all non-public information received from Client. Confidential information will not be disclosed to third parties except as necessary to perform the Services or as required by law.
Client is responsible for granting access securely (e.g., via user invites or password managers). Deladesk discourages the sharing of raw passwords by email.
6. Intellectual Property
All work product created by Deladesk for Client under this Agreement (e.g. reports, CRM entries, lead databases, transaction files) shall be the sole property of Client.
Deladesk retains ownership of proprietary systems, templates, and internal SOPs used to deliver Services.
7. Limitation of Liability
Deladesk shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits. Deladesk’s total liability under these Terms shall not exceed the amount of fees paid by Client in the one (1) month immediately preceding the claim.
8. Cancellation Policy
Client may cancel service at any time with seven (7) days’ written notice prior to the next billing date. No refunds will be provided for partial months of service.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Ireland, without regard to conflict of law principles.
